This English translation is provided for convenience. The Dutch version (algemene voorwaarden) is the legally binding text. Read the Dutch terms and conditions.

This page is the binding version

If you also get a pdf or a printout of these terms and conditions from us, that is a print of this text. Should the two ever differ, what is stated here applies. The reason: this page is linked at the foot of every page and next to every send button, so you can read it before you commit to anything. That is exactly what the law asks of us.

Version: 16 September 2026. For an order that is already under way, the version you were given when it was entered into continues to apply.

Part I

General section

Article 1 · What we mean by what

  • We / us / our: Stevig Vastgoedonderhoud, also trading under the name Stevig Kitwerk, established in Utrecht and registered with the Chamber of Commerce (KvK) under number 77717244.
  • You / customer / client: the person or organisation that hires us for sealant work.
  • Consumer: a private customer who does not place the order for a profession or business.
  • Business client: a customer acting for a profession, business, foundation, association, homeowners' association (VvE) or other organisation.
  • Agreement: all arrangements we make together, including the quote, the order confirmation, any annexes and these terms and conditions.
  • Work: the sealant work and the preparatory or additional activities stated in the quote or order confirmation.
  • Additional work: work that is not included in the original price or description.
  • Handover: the moment we state that the agreed work is finished.
  • In writing: by letter, e-mail, WhatsApp or another digital channel that we use together.
  • Force majeure: a situation beyond our reasonable control that means we cannot work, cannot work safely or cannot work on time.

Article 2 · What these terms and conditions apply to

  • These terms and conditions apply to all quotes, orders and sealant work of Stevig Kitwerk.
  • Arrangements in the quote or order confirmation take precedence if they differ from these terms and conditions.
  • Terms and conditions of a business client apply only if we have accepted them in writing in advance.
  • Statutory rights of consumers always continue to apply. A provision that conflicts with them does not apply to the consumer.
  • Is part of these terms and conditions invalid? Then the other parts simply continue to apply. We replace the invalid part with a reasonable arrangement that comes as close to it as possible.

Article 3 · What we do (sealant work)

  • We carry out professional sealant work, indoors and outdoors, for bathrooms, toilets, kitchens, sanitary ware, floors, walls, glass, window frames, facades, connections and expansion or connection joints, among other things.
  • The exact locations, numbers of metres, joint types, materials, colours and preparatory work are stated in the quote.
  • Removing old sealant, cleaning, degreasing, priming, masking and fitting backing rod are included only if the quote or the work description says so.
  • We only carry out sealant work on natural stone if the quote expressly says so. Without that mention, natural stone falls outside the order.
  • Tiling, grouting, plastering, painting, plumbing, structural repair, sealing membranes, leak detection, mould treatment and the repair of damp or water damage are not included, unless we agree so in writing.
  • Removing old sealant, packaging and other waste is included only if the quote says so.

Article 4 · Quotes, prices and entering into the agreement

  • Quotes are valid for 30 days, unless the quote states a different period.
  • Prices for consumers include VAT. Prices for business clients exclude VAT, unless stated otherwise.
  • Our quote is based on the information, photos, measurements and visible situation available at that time.
  • The agreement comes into being as soon as you accept the quote in writing, sign an order confirmation or let us start with your permission.
  • Do the actual measurements, numbers of metres or circumstances turn out to be clearly different from those stated? Then we may adjust the price and the schedule in consultation.
  • You choose and check the colour before we start. A colour on a screen, on a colour chart or on a sample can differ slightly from the final result. Small colour differences can also exist between production batches.
  • Obvious clerical, calculation or typing errors in a quote do not bind us. If we discover such an error, we will let you know as soon as possible and you will receive a corrected quote.

Article 5 · Additional work and unexpected circumstances

  • While old sealant is being removed or the surface is being prepared, hidden problems can become visible, such as damp, mould, loose tiles, damaged edges, deep or overly wide joints, old adhesive and sealant residue or a contaminated substrate.
  • Extra cleaning, drying time, primer, backing rod, repair, extra labour or an extra visit counts as additional work if it was not in the original quote.
  • We discuss additional work and its cost with you first. Only where immediate action is needed to prevent damage or an unsafe situation may we take the necessary measures, and we will inform you as soon as possible.
  • We may charge for waiting time or extra visits because the work site is not ready, other tradespeople are in the way or we are not given access.
  • Do you want to drop part of the work after the agreement has been entered into? Then we deduct only the costs we actually save as a result. Costs already incurred, materials already ordered and labour time already reserved remain payable.

Article 6 · What we need from you

  • You make sure that we can reach the work site safely and without obstruction at the agreed time.
  • The room is empty enough for us to work properly. Loose items, fragile objects, pets and people stay out of the work zone.
  • Power, water, normal lighting, somewhere to park and any access passes or permits are available, unless we agree otherwise.
  • The substrate and the adjoining work are sufficiently dry, clean, sound and ready for sealant work.
  • You tell us in advance about known leaks, damp problems, mould, movement, earlier silicone treatment, chemical cleaning, fragile materials and other particulars.
  • You are authorised to place the order and you arrange permission from the owner, the landlord, the homeowners' association (VvE) or others involved if that is needed.
  • After handover you follow our instructions on drying time, ventilation, cleaning and not using or wetting the joint for a while.

Article 7 · Substrate, existing defects and leaks

  • We assess the work site in advance only in so far as defects are visible or reasonably recognisable. We do no destructive investigation, unless that has been agreed separately.
  • A sealant joint only works well if the substrate, the structure and the connection are suitable. You remain responsible for existing structural defects and for work by others.
  • Sealant work is not a substitute for proper waterproofing behind tiles, sound grouting, securely fitted sanitary ware, correct plumbing or structural repair.
  • When old sealant is removed, existing damage, discolouration, loose parts or earlier defects can become visible. We are not liable for those, except where the damage is caused by careless action on our part.
  • Do we have doubts about the adhesion or the safety? Then we may pause the work, carry out a test or advise repair first. We discuss the consequences for the price and the schedule with you.

Article 8 · How we carry out the sealant work

  • We work carefully, safely and to normal standards of craftsmanship, with materials that suit the application and the substrate.
  • Is an agreed product temporarily unavailable? Then, after consulting you, we may use a technically equivalent product. Where a visible difference in colour or gloss is possible, we ask for your approval first.
  • Sealant work is handwork. Small differences in joint width, shape, gloss or connection are possible and do not automatically count as a defect.
  • We determine the shape and the size of the joint partly on the basis of technical suitability. A new joint therefore does not have to have exactly the same shape or width as the old joint.
  • Curing depends on the product, the joint size, the temperature, the humidity and the ventilation. You only use, load, clean or wet the joint after the period we state.
  • We may engage employees, subcontractors or other tradespeople to carry out the work. We remain responsible for the work we have taken on.

Article 9 · Scheduling and force majeure

  • We agree a schedule together. A planned date is a target date, unless we have agreed in writing that it is a firm completion date.
  • Outdoor work can only be carried out in suitable temperature, dryness and weather conditions.
  • In the event of force majeure we may postpone the work. For example illness, an accident, extreme weather, fire, government measures, strikes, transport problems, material shortages or an unsafe work site.
  • We let you know what is going on as soon as possible and schedule a new date in consultation.
  • Does the force majeure last longer than 30 days? Then both parties may end the part that has not yet been carried out. Work already carried out and reasonable costs already incurred remain payable.

Article 10 · Handover and first use

  • The work has been handed over as soon as we report that it is finished and you have had the opportunity to look at the result.
  • Where possible we go through the work together. You report visible points of concern straight away, so that we can assess them.
  • A small repair point that does not stand in the way of normal use does not fully suspend the handover or the payment. We repair a justified point within a reasonable period.
  • Use of the room or the joint does not mean that a consumer waives statutory rights.
  • Damage because the joint is touched, loaded, cleaned or wetted too early is not our responsibility.

Article 11 · Guarantee on our sealant work

  • We give a 2-year guarantee on the adhesion and the proper execution of new sealant work that we have applied ourselves, unless the quote expressly states a different period.
  • The guarantee period starts on the day of handover.
  • In the case of a justified guarantee claim, we repair the defective part free of charge within a reasonable period.
  • The guarantee applies to the joint we applied, at the original location. It is not automatically transferable without our written approval.
  • This extra guarantee does not limit the statutory rights of a consumer.
  • Repair that we carry out under the guarantee does not extend or renew the original guarantee period. The statutory rights of consumers continue to apply.

Article 12 · When the guarantee does not apply

  • Normal wear, ageing or maintenance that is part of sealant work.
  • Mould, deposits, discolouration or soiling caused by insufficient ventilation, persistent damp, soap, limescale, nicotine, cosmetics, cleaning products, chemicals or environmental influences, unless this is demonstrably the result of an error on our part.
  • Cracking or detachment caused by movement, shrinkage, settlement, vibration, deflection or working of tiles, sanitary ware, window frames, floors, walls or other building parts beyond what the sealant joint can technically take.
  • Leaks or damp problems arising from pipework, drainage, grouting, tiles, sealing layers, the structure or other causes outside the sealant work we applied.
  • Damage caused by sharp objects, steam or high-pressure cleaning, aggressive products, pets, vandalism, fire, frost, third parties or work carried out after our visit.
  • Alteration, painting over, repair or removal by you or by a third party without consulting us.
  • An unsuitable substrate or material supplied by you about which we warned you in advance.
  • Temporary emergency repairs, local repairs to existing sealant or work for which the quote states a specific guarantee limitation.
  • Failure to follow our instructions on curing, use, ventilation, cleaning or maintenance.
  • An exclusion applies only to the part of the damage that was caused by that cause.

Article 13 · Complaints and repair

  • Are you not satisfied? Let us know in writing as soon as possible, with a clear description and with photos where possible.
  • You give us a reasonable opportunity to look at the work and to repair a justified defect ourselves.
  • If you have a third party repair it first without consulting us, we do not have to reimburse those costs and the guarantee for that part may lapse. In a genuine emergency you report it as soon as possible and you limit the damage.
  • A complaint suspends only the reasonably disputed part of the payment. You pay the part that is not in dispute on time as usual.
  • For consumers, the complaints procedure in article 18 applies. For business clients, article 20 applies in addition.

Article 14 · Liability

  • We are liable for direct damage that demonstrably arises from an error attributable to us.
  • We are not liable for damage caused by incorrect or incomplete information from you, hidden defects, an unsuitable substrate, work by third parties or failure to follow our instructions.
  • You take reasonable measures to prevent or limit damage and you report imminent damage straight away.
  • Limitations of liability do not apply in the event of intent or wilful recklessness on our part, nor where the law does not permit a limitation.
  • For business clients, the limitations in article 22 apply in addition.

Article 15 · Cancelling or rescheduling

  • Do you want to cancel or reschedule an appointment? Let us know in writing as soon as possible.
  • We may pass on the costs we have already reasonably incurred, such as materials ordered, hired help, parking costs, transport and special preparatory work.
  • In the case of a late cancellation, or if we come for nothing because there is no access or the work site is not ready, we may also charge a reasonable fee for reserved time that we could no longer use otherwise.
  • The total cancellation fee is never higher than the agreed order value for the cancelled part.
  • For a consumer within the statutory cooling-off period, article 17 takes precedence. For business clients, the rules in article 21 apply in addition.

Part II

Additional rules for consumers

Article 16 · Payment by consumers

  • The payment term is 14 days from the invoice date, unless we agree otherwise in writing.
  • A deposit or payment in instalments applies only if the quote says so. The amount must be reasonable for the work and the materials.
  • Do you not pay on time? Then we first send a free payment reminder with a statutory period of 14 days in which to pay after all.
  • Only once that extra period has expired may we charge statutory interest and the collection costs that the law allows.
  • We do not charge a fixed penalty per reminder.
  • Do you justifiably disagree with part of the invoice? Then you may temporarily withhold a reasonable amount. You do pay the part that is not in dispute on time.

Article 17 · Cooling-off period for an agreement at a distance or at your home

  • Do you, as a consumer, enter into the agreement online, by telephone or away from our business premises, at your home for example? Then you have a cooling-off period of 14 days where the law provides for it.
  • The cooling-off period starts on the day after the agreement is entered into. You do not have to give a reason for withdrawing.
  • Do you want us to start within the cooling-off period? Then we record your express request in the quote or the order confirmation. No separate form is needed for that.
  • Do you withdraw after we have started at your request but before the work is completely finished? Then, in so far as the law allows this, you pay a proportionate amount for the part of the total order that has already been carried out.
  • You only lose the right of withdrawal after full performance if you expressly agreed in advance to immediate performance and confirmed that you lose this right once performance is complete.
  • For an emergency repair that you expressly asked for, a statutory exception can apply to the strictly necessary urgent work.
  • You can withdraw by e-mail, by letter or with the model form in annex A.
  • Where the agreed start date falls within the statutory cooling-off period, the private client expressly requests Stevig Kitwerk to start the work on that date. The client understands that work already carried out must be paid for and that the right of withdrawal lapses once the order has been carried out in full.

Article 18 · Complaints, statutory rights and disputes for consumers

  • Report a defect as soon as possible after you discover it. A preferred period of 14 days helps us to assess the cause properly, but your statutory rights do not lapse automatically if you report it later.
  • We respond to a clear complaint as soon as possible and normally within 14 days.
  • Our guarantee is an extra service and comes on top of the rights you have by law.
  • Can we not work it out together? Then you can put the dispute before the court that has jurisdiction by law.
  • Nothing in these terms and conditions limits mandatory consumer protection.

Part III

Additional rules for business clients

Article 19 · Payment by business clients

  • The payment term is 14 days from the invoice date, unless we agree otherwise in writing.
  • We may ask for a deposit, instalment invoices or security for payment, especially for larger orders or specially ordered materials.
  • Once the payment term has expired, you are in default without any further notice of default.
  • From that moment we may charge the statutory commercial interest and reasonable extrajudicial collection costs, with at least the statutory minimum amount.
  • You may not set off or suspend payments, except in so far as the law does not allow that or we approve it in writing.
  • We may pause work and deliveries for as long as invoices that are due or securities we have asked for have not been settled.

Article 20 · Inspection and complaints by business clients

  • You inspect the work straight away at handover.
  • You report visible complaints in writing and clearly described within 7 calendar days of handover at the latest.
  • You report a hidden defect within 7 calendar days at the latest after you discovered it or could reasonably have discovered it, and within the applicable guarantee period.
  • If you do not report in time, the work counts as accepted in so far as the law allows this.
  • You always give us a reasonable opportunity first to investigate and repair the alleged defect.

Article 21 · Suspension, termination and cancellation of business orders

  • We may pause or end the order immediately if you do not pay, give no security, seriously fail to keep to arrangements, go bankrupt, apply for a suspension of payments, if an attachment is levied or if the work site is unsafe.
  • On termination you pay for the work carried out, the materials ordered, the costs incurred and the loss that reasonably follows from the early termination.
  • Do you cancel a business order? Then, on top of the costs already incurred, we may charge a reasonable fee for reserved time and lost income, in so far as we can no longer use that time otherwise.

Article 22 · Liability for business orders

  • We are not liable for indirect damage, such as consequential loss, loss of turnover, lost profit, production standstill, missed savings or damage to third parties because a room is unavailable.
  • Our total liability is limited to the amount our liability insurance pays out for the case in question, plus the deductible.
  • Does the insurance not pay out? Then our liability is limited to the invoice amount of the part of the order to which the damage relates, up to a maximum of € 10,000.
  • You indemnify us against claims by third parties that arise from incorrect information, defects or circumstances for which you are responsible.
  • These limitations do not apply in the event of intent or wilful recklessness on our part, or where the law does not allow a limitation.

Part IV

Final provisions

Article 23 · Privacy, photos, videos and documents

  • We use your details for the quote, the work, the scheduling, invoicing, the guarantee, our administration and statutory obligations.
  • We only share details where that is necessary, with a supplier, subcontractor, bookkeeper, insurer or legal adviser for example, or where the law requires it.
  • We may take photos and videos to record the initial situation, the work, the handover or a complaint.
  • We may use photos and videos without recognisable people, number plates, house numbers or other clearly traceable details for our portfolio, unless you object in writing before handover.
  • Our quotes, work descriptions, drawings, photos and videos remain ours. You may not use them commercially without permission or give them to another contractor in order to copy our proposal one to one.

Article 24 · Applicable law and final arrangements

  • Dutch law applies to the agreement and to these terms and conditions.
  • We always try to settle a difference of opinion together first.
  • For consumers, the court that has jurisdiction by law is competent.
  • For business clients, the Midden-Nederland District Court is competent, unless mandatory law designates a different court.
  • We may amend these terms and conditions for new orders. For an existing order, the version that was provided when that order was entered into continues to apply.
